Federal Judge Makes Important Ruling in Xarelto Lawsuits

As the number of Xarelto lawsuits rises due to the drug’s link to uncontrollable bleeding in patients, cases filed in federal court have been assigned to a single judge in the Eastern District of Louisiana — Judge Eldon Fallon. In May 2015, Judge Fallon ordered lawyers in the Xarelto lawsuits to select specific cases that will now enter the information-gathering stage of a lawsuit, known as discovery. The court’s order also includes a number of deadlines for other discovery-related issues.

Xarelto (rivaroxaban) is an anticoagulant, or blood thinner, that is popularly prescribed for patients with atrial fibrillation or to prevent deep vein thrombosis for patients undergoing surgery. Xarelto is made and marketed by Bayer HealthCare and Johnson & Johnson’s Janssen Pharmaceuticals.

More than 400 lawsuits have been filed against Xarelto’s makers. The Xarelto lawsuits claim that Bayer and Janssen chose not to warn about the dangerous potential side effects of Xarelto. Once a patient being treated with Xarelto starts bleeding, there is no antidote to stop it. As a result, Xarelto may cause severe bleeding injuries and death. This is not the case with traditional blood thinners like Coumadin or warfarin. With those anticoagulants, doctors can administer vitamin K to stop the bleeding.

The consolidation of federal Xarelto lawsuits in Louisiana is part of a Multi-District Litigation (MDL). The purpose of an MDL is to reduce time and expenses for everyone by having one judge decide issues that hundreds or thousands of cases have in common.
