Covidien to Settle Transvaginal Mesh Lawsuits

A group of women injured by Covidien transvaginal mesh products have settled their lawsuits against the medical device maker. The settlement comes in just a portion of the 11,000 vaginal mesh cases filed against Covidien.

Dollar Amount of Recent Vaginal Mesh Settlement is Confidential

The vaginal sling settlement is confidential, according to a filing made recently in the federal court in West Virginia where the lawsuits are pending. The number of cases involved and the amount of the settlement are therefore unknown.

Covidien mesh devices reportedly are involved in around 11,300 filed and unfiled claims. For the third quarter of 2014, the company recorded a $180 million pre-tax charge related to transvaginal mesh litigation.

According to filings with the U.S. Securities and Exchange Commission, two Covidien subsidiaries supplied the dangerous vaginal mesh devices to another manufacturer, which sold the unsafe medical devices under that company’s brand. Covidien has agreed to indemnify the company for vaginal mesh lawsuits filed against it. In separate SEC filings, C.R. Bard has revealed that it sold mesh implants supplied by two Covidien units and that Covidien is obligated to defend or indemnify Bard in roughly half of the 14,000 vaginal mesh claims filed against it.

Approximately 100,000 transvaginal mesh lawsuits are pending in U.S. state and federal courts against product manufacturers. The unsafe medical devices have caused severe and debilitating injuries, including painful bleeding, nerve damage and infections. Many women have been forced to endure additional surgeries to have the mesh devices removed.
